Content Provider Agreement
This Content Provider Agreement (the "Agreement") is entered into between Monetifans ("Platform") and the content provider ("Content Provider") regarding the submission and distribution of content on the Monetifans website.
1. Content Submission
Content Provider agrees to submit content to the Platform for distribution and display on the Monetifans website. Content may include, but is not limited to, photos, videos, live streams, and other media.
2. Prohibited Activities
Content Provider agrees that any content submitted shall not engage in any prohibited activity or illegal behavior, and shall not violate any industry standards or guidelines. Prohibited activities include, but are not limited to, explicit content involving minors, violence, harassment, hate speech, and infringement of third-party rights.
3. Consent and Release
Content Provider warrants and represents that written consent has been obtained from all individuals depicted in the content, confirming the following:
a. Consent to be depicted in the content submitted to the Platform.
b. Consent to allow for the public distribution of the content and to upload the content to the Monetifans website.
c. If the content will be made available for downloading by other users, consent to have the content downloaded.
d. Verification of the identity and age of all persons depicted in the content to ensure that all individuals are adults (18+) and able to provide supporting documents upon request.
4. Intellectual Property Rights
Content Provider retains all intellectual property rights in the content submitted. By uploading content to the Platform, Content Provider grants Monetifans a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the content on the Monetifans website.
5. Compliance with Laws
Content Provider agrees to comply with all applicable laws, rules, and regulations related to content creation, distribution, and copyright. Content Provider shall be solely responsible for any legal consequences resulting from the content submitted to the Platform.
6. Content Management
Monetifans reserves the right to review, approve, and manage all content submitted to the Platform. Monetifans may, at its sole discretion, remove or restrict access to any content that violates this Agreement or infringes on any third-party rights.
7. Termination
Either party may terminate this Agreement at any time with or without cause by providing written notice to the other party. Upon termination, Content Provider's access to the Platform and the ability to submit content shall cease.
8. Indemnification
Content Provider agrees to indemnify and hold Monetifans harmless from any claims, damages, or liabilities arising from the content submitted, including any claims related to the lack of consent from individuals depicted in the content.
By clicking "Agree" or submitting content to Monetifans, Content Provider acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Content Provider Agreement.
